How to Use This Book
Use this book as a working teaching guide, not as a dictionary of isolated tax rules. Read the narrative first, then test yourself with the questions before opening the model answers.
The core learning method
1. Start with the commercial facts
Identify the transaction, the asset or income stream, the people and entities involved, ownership, timing and the commercial objective. Do not start with a section number simply because it was used in a previous problem.
2. Map each issue to the exact law
Move from the relevant Act to the Part, Division, Subdivision, section, subsection and paragraph where applicable. Identify the elements and definitions that must be satisfied. State what legal question the provision answers.
3. Use authority for a proposition
Cases and ATO materials should not be name-dropped. Explain what proposition the authority establishes, what statutory words it interprets and why it changes the analysis of the facts.
4. Calculate transparently
Tax advice often fails when a correct legal idea is combined with an unexplained number. Show the formula, assumptions, rates, thresholds and apportionment. If a current threshold is date-sensitive, verify it before calculating.
5. Attempt the questions before reading the answers
Each chapter has a separate question page and model-answer page. The separation is deliberate. Commit to your own issue list and reasoning before comparing it with the model answer.
6. Return to the primary sources
The blue links in the electronic edition take you to legislation, cases, ATO materials and verified publisher/resource pages. Use them. A strong tax lawyer checks the law itself.
